Any estimate or quote we provide is based on information available at the time of assessment. Estimates are not final until a written agreement is signed by both parties. Prices may change if the scope of work changes, if site conditions differ materially from what was assessed, or if materials costs change before work begins.
We will notify you before proceeding with any work that would result in additional charges beyond the agreed scope. We will not perform out-of-scope work without your approval.
Scheduling is subject to availability. We will confirm your appointment date and any preparation requirements before work begins. You are responsible for ensuring the work area is accessible and cleared as directed.
If you need to cancel or reschedule, please notify us as soon as possible. Cancellations made less than 48 hours before a scheduled start may result in a cancellation fee to cover mobilization costs. We reserve the right to reschedule due to weather conditions, material delays, or other circumstances outside our control.
Payment terms will be specified in your written agreement or invoice. Unless otherwise agreed in writing, payment is due upon completion of the project. We reserve the right to require a deposit before materials are ordered or work begins on larger projects.
If payment is not received within the time specified in your agreement, we reserve the right to charge a late fee and to pursue collection through lawful means, including filing a mechanic lien on the property where work was performed, as permitted under Texas law.
You are responsible for providing accurate information about your project, ensuring the work area is accessible, clearing the area of personal property before work begins, and following all care and maintenance instructions provided after completion. Failure to meet these responsibilities may affect the quality or longevity of the finished work, and we are not liable for defects or failures caused by your failure to comply.
We stand behind the quality of our work. Any specific warranty applicable to your project will be stated in your written agreement. Absent a written warranty, our work is provided on an "as is" basis.
Warranties do not cover damage or failure caused by: improper use or maintenance after project completion, damage caused by third parties, acts of nature including flooding or freeze events, or changes to the substrate or site conditions after our work is complete.
THE SITE AND ANY CONTENT ON IT ARE PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE.
To the maximum extent permitted by applicable law, Odessa Concrete Polishing & Epoxy Flooring shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to the use of the Site or our services, including but not limited to loss of profits, loss of data, or loss of business opportunity.
Our total liability to you for any claim arising from or related to our services shall not exceed the amount you paid us for the specific work that is the subject of the claim.

These Terms and Conditions are governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law provisions. Any legal action not subject to arbitration shall be brought exclusively in the state or federal courts located in Odessa, Texas.
We reserve the right to modify these Terms and Conditions at any time. Changes will be effective upon posting to the Site with an updated effective date.
